5) If the Renter does not return the vehicle by the time agreed upon in this rental agreement, or does not enter into an agreement with the Lessor on an extended lease, the Lessor or the police are authorized to repossess the vehicle without further notice, at the cost of the Renter. An extension to the rental is dependent upon the consent of the Lessor. If the Renter returns the vehicle 1 hour, or later, after the rental period has expired, the Lessor is authorized to collect up to 24-hours worth of rental fee under the terms of this rental agreement. For each calendar day that begins after that, the Lessor is authorized to collect up fees in accordance to pricelist.

7) The Renter has strict liability (i.e., liability without any negligence) for all damages to the vehicle towards the Lessor, including, but not limited to damages the Lessor suffers due to theft of the vehicle or if damages to the vehicle are not compensated by the Lessor´s insurance company.
8) The Renter has strict liability for damage resulting from use of the vehicle which is not compensated by the Lessor´s insurance company. This includes, but is not limited to, injury or death to passengers and other people.

Driving on roads that are F-marked on official maps, along with the roads Kjalvegur and Kaldidalur. This concerns all our cars and suvs. c. Driving under the influence of alcohol or other intoxicants. d. Driving across or in rivers or any kind of water course. e. Driving on banks of snow or on ice.
10) In the event of a collision or accident, the Renter shall immediately notify the appropriate police authorities, as well as the Lessor, of the incident, and the Renter may not leave the scene where the collision or accident took place, before such has been done, and the police have arrived. The Renter shall promptly fill out damage-reports, in case of damage etc.
11) The Renter agrees to pay the Lessor, upon request, a deposit amounting to the estimated cost of renting the vehicle and/or all other fees or payments foreseeable due to the Lessor with regard to the renting of the vehicle.

13) The Renter is liable for all parking meter charges and fines for breaking traffic laws.
14) The Renter shall pay all costs incurred in connection with collecting payment from the Renter.
15) The Renter is liable for all costs that arise from necessary transportation of the vehicle to the premises of the Lessor, due to damage to the vehicle, or due to other reasons, and payment of an own risk fee (CDW) has no effect in this respect, unless otherwise agreed upon by the parties to this rental agreement.
Obligations of the Lessor:
16) The Lessor undertakes to ensure that the vehicle meets the demands made of it.
17) The vehicle shall be passed on to the Renter with the fuel tank full of fuel.
18) If the vehicle malfunctions due to normal wear, or due to other reasons not chargeable to the Renter, the Lessor shall supply the Renter with a comparable vehicle, as soon as possible, or see to it that repairs are carried out, as soon as possible, at a place determined by the Lessor. This does not affect payment of the rental fee or other payments that the Renter is obliged to pay under this rental agreement. Lessor does not pay any retribution or damages in those instances that are mentioned above, neither with respect to accommodation, or anything else.
19) The Lessor shall inform the Renter of the content of this rental agreement, particularly as regards the obligations that the Renter undertakes by signing it.
20) The Lessor shall use his best efforts to inform a foreign Renter of Icelandic traffic regulations, traffic signs, and regulations banning off-road driving. The Lessor shall particularly point out the dangers stemming from animals on the roads.
21) If the Lessor wants to limit the use of the vehicle with regard to its equipment and/or road conditions, or in other respects than demonstrated in this rental agreement, it shall be done in writing when this rental agreement is signed.
22) The Lessor undertakes to maintain valid liability insurance for the Lessor´s business operations.
23) The Lessor is not responsible for the disappearance of or damage to property that the Renter, or any other party, leaves in or transports with the vehicle.
Insurance and own risk fee (Collission Damage Walver – CDW):
24) The rental fee includes mandatory vehicle insurance, i.e., liability insurance and accident insurance for the driver and the owner.
25) Third-party liability insurance and accident insurance for owner and driver will consist of the amount stipulated by Icelandic law at any given time. The Renter´s own risk (also termed as “deductible”, i.e., the amount that must be paid out of pocket by the Renter for covered losses before an insurance company pays a claim) with regard to damage to the vehicle amounts up to the full value of the vehicle.
26) The Renter can pay a separate own risk fee (CDW) with regard to the Renter´s own risk, and by doing so reduce his or hers own risk with respect to damage to the vehicle. Regardless of whether such own risk fee (CDW) is paid; the Renter is always obliged to pay a minimum amount in case of damage to the vehicle. That amount is determined in the Lessor´s price list.
27) The amounts of own risk fees (CDW) are variable depending upon the damage-sum the relevant own risk fee covers. With regard to amounts of own risk fees (CW) and which damage-sum the payment of such fees cover, reference is made to the Lessor´s price list, which forms a part of this rental agreement if an own risk fee is paid. Payment of an own risk fee (CDW) does not cover:
a. Intentional damage or damage due to gross negligence on the influence of alcohol, stimulants or sedatives, or in any other way incapable of driving the vehicle in a safe manner.
b. Damage resulting from the driver being under the influence of alcohol, stimulants or sedatives, or in any other way incapable of driving the vehicle in a safe manner.
c. Damage due to race or test driving.
d. Damage due to war, revolution, civil unrest and riots.
e. Damage done by animals.
f. Holes burned into seats, carpets, or mats.
g. Damage affecting only wheels, tries, suspension, batteries, glass (other than windows), radios, or loss by theft of parts of the vehicle and damage resulting form this.
h. Damage caused by driving on tough roads to the vehicle´s transmission, drive and other parts that are in or attached to the chassis; damage to the chassis resulting from the vehicle scraping bottom on rough roads, e.g., ridges being left by road graders; stones lodged in the road surface or on the shoulder of the road. The same applies to damage occurring when stones are thrown up, striking the underside of the vehicle during driving.
i. Damage resulting from driving in places where vehicle traffic is banned, such as on paths, tracks, banks of snow, ice, unbridged rivers or streams, beaches, places only accessible at low tide, or other trackless areas. However, payment of an own risk fee will cover damage due to the driver being forced to leave the road, e.g., due to road repairs.
j. Damage to vehicles that occur when driving on roads marked F on official maps.
k. Damage caused by sand, gravel, ash, pumice, or other kind of earth material being blown onto the vehicle.
l. If the vehicle is transported by sea, a payment of an own risk fee does not cover damage caused by sea spray/seawater.
m. Water damage to engine of the vehicle.
General provisions:
28) The Lessor is authorized to repossess the vehicle at any time, without further notice, if it has been parked in an illegal way, or if it has been used in any other way which is contradictory to this rental agreement or laws and regulations, or if the vehicle seems abandoned.
29) Should the Lessor utilize these rights as aforementioned, it has no effect on the Renter´s obligation to pay the rental fee, or other obligations of the Renter under this rental agreement. Notwithstanding the aforementioned, the Lessor´s re-renting of the vehicle to a third party shall be deducted from the amount of the rental fee payable by the Renter, to the extent as the rental term of this rental agreement and the rental agreement made with a third party are the same, and to the extent rental fee from a third party covers the rental fee of the Renter per that period of time.
30) The Lessor is authorized to charge to the Renter´s credit card the rental fee and other payments that the Renter is obliged to pay under this rental agreement, including, but not limited to, payments due to damage to the vehicle which occur whilst the vehicle is under the responsibility of the Renter, and the Lessor shall alone have the discretion as to when that shall be done, and whether it is done all at once or not. The term of this particular right of the Lessor is 6 months after the vehicle has been returned to the Lessor.
31) The Renter confirms by signing this rental agreement that the Renter received the vehicle and it´s accessories in good shape and order.
32) This rental agreement shall always be kept in the vehicle during the time which the vehicle is under the responsibility of the Renter.
33) Additions and amendments to the conditions and provisions of this rental agreement shall be null and void unless agreed upon in writing by both parties.
34) Icelandic law applies to this rental agreement and agreements made on the basis of the terms cited above. This includes any claims for compensation that might be made. This applies both to the basis for and the calculation of compensation. The same applies to claims for damages based on liability outside agreements. If legal disputes arise concerning this rental agreement, they will be heard exclusively before the Lessor´s legal venue.
35) Disputes between the parties to this rental agreement can be submitted to the active Arbitration Committee of the Icelandic Consumers Association and the Icelandic Travel Industry Association.
